Most of the time no its illegal, but some rural counties and parishes will let you get away with it since they do not test for it. Obviously the vehicle must be registered in those particular locations to use their guidelines. In my parish and many other rural parishes in Louisiana (Louisiana has parishes instead and all other states in the US have counties) they do not test smog, sound level, computer read and gas cap test at all for any vehicle unless its an all parish testing location. For many independent places its as long as all the lights work, muffler attached, horn works, the vehicle drove there and can leave on its own, windshield cracks dont reach the edge, body parts held on with less than 2 bungee cords, any duct tape is painted to match the car, no metal worn through the tires, and paperwork and insurance is good then it passes. Straight pipe exhaust with no muffler that rattles the windows at idle, passes. Absurd amounts of smoke and barely runs, passes. Rear/front bumper held on using duct tape with bungee cord and chicken wire but license plate attached and lights work, passes. Broken suspension components, depends on what time of day you get it checked. Roof tail light out, fail. Blinker blinks too fast, fail. Highbeam light out, fail. Move to a rural parish/county, make a monster truck with the tailpipe straight piped through the hood with farm tractor tires and a 12 inch lift. It passes inspection here, seen a few examples. I regularly passed inspection with bad catalytic converters, bad O2 sensors, severe engine misfires, even missing body panels. Ive once been passed with a sheared strut and bent tie rod before, not like he couldnt tell because I also didnt have a bumper. Still passed and no I dont know the guy, these where over many different testing places not just one. The testing places in the more populated areas and cities are much stricter.

Cars with plain catalytic converters, I'd assume that's fairly hit or miss and largely depends on the levels of hydrocarbon and carbon monoxide pollutants in the air. What's gonna make you really want to sit down and rethink some things though, is the situation with semi trucks and cars with diesel engines. Not only do diesels have a catalytic converter (it's a bit different than those on gasoline engines, but same basic idea) but they also have a DPF, or diesel particulate filter. It's basically a very large and very fine ceramic filter element that traps all the unburned soot and holds it so it can be completely burned up later. Essentially the only thing that comes out the exhaust of a semi made in or after 2010 is air, carbon dioxide, and steam. That's it. Zero particulates, zero unburned hydrocarbons, zero carbon monoxide. Zilch. Unless we're in a pristine forest, the air coming out my exhaust is way cleaner than the air that went in my intake. I should note that some idiots insist on performing a surgery known as a DPF delete. They refer to it as “rolling coal,” and frankly I wish they'd all die in a fire. They don't count.
